IP & DMCA
Effective 2026-07-27
Effective date: 2026-07-13 · Version 1.0
Operator of the platform: Crater Ink Studios LLC, a Pennsylvania limited liability company, operator of the Why Stationery marketplace, 4934 Swamp Rd, Felton, PA 17322, USA. Applies to: everyone who uses Why Stationery — buyers, sellers, and visitors. Governing law: Pennsylvania and applicable US federal law, including the Digital Millennium Copyright Act, 17 U.S.C. § 512.
1. Respect for intellectual property
Why Stationery is a marketplace for original and personalized stationery. Everyone who uploads, lists, or personalizes a design must have the right to do so. We remove infringing material and, in appropriate cases, terminate repeat infringers.
2. What buyers promise about uploaded content
When you upload artwork, a logo, a photo, or text for a custom order, you confirm — as you already do at checkout — that you own it or have permission to use it, and that printing it for your order does not infringe anyone's rights. You grant the shop making your order a limited license to use your uploaded content only to produce and fulfill that order. Your uploaded content remains yours; the shop may not reuse or resell it beyond your order.
Photos of people. If your uploaded content includes a photograph or the likeness of an identifiable person, you confirm you have that person's permission to use it — including any publicity, privacy, or model-release rights in their image — and, where the person is a minor, the permission of their parent or legal guardian. Do not upload a photo of someone who has not agreed to appear on your printed item. We may decline or remove an order whose uploaded content appears to use a person's image without permission.
3. What sellers promise about listings
When a shop lists a design, the shop certifies — through an acknowledgment it must complete before publishing — that it owns or has licensed all artwork, fonts, and other content in that listing and has the right to sell it.
4. License you grant to Why Stationery
So the platform and its design tools can work, you grant Why Stationery a non-exclusive, royalty-free license to host, store, display, render, and generate print-ready files from the designs and content you upload or create — for the purpose of operating the service. We use your content in marketing or promotional thumbnails only with your consent. This license ends when you delete the content or your account, except for copies we must retain to complete an order, meet a legal obligation, or resolve a dispute.
5. Who owns a personalized design
- A shop keeps the rights to its own template or base design.
- You keep the rights to the content you upload (your names, text, photos, logos, artwork).
- Neither party may resell or redistribute the other's contribution outside your order.
6. Honest provenance
Shops mark how a design's artwork was made — hand-drawn/painted, photographic or digital, or AI-generated — and that marking is shown to buyers. Misrepresenting how artwork was created (for example, passing off AI-generated art as hand-drawn) is a violation of this policy and of the Prohibited & Restricted Content Policy.
7. Reporting copyright infringement (DMCA notice-and-takedown)
If you believe content on Why Stationery infringes your copyright, send a written notice to our designated agent (below). Under the DMCA, a valid notice must include:
- your physical or electronic signature;
- identification of the copyrighted work you say was infringed;
- identification of the material you say is infringing, with enough detail (such as the listing URL) for us to find it;
- your contact information (address, telephone, email);
- a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and
- a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner.
On receiving a valid notice we will remove or disable the material and notify the shop that posted it. We aim to act on a properly submitted notice within 5 business days.
Designated Agent for Notice of Claimed Infringement:
Copyright Agent, Crater Ink Studios LLC — Why Stationery 4934 Swamp Rd, Felton, PA 17322, USA Email: hello@craterinkstudios.com US Copyright Office designated-agent registration no.: DMCA-1076708
8. Counter-notification
If your material was removed and you believe that was a mistake or misidentification, you may send our designated agent a counter-notice including your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your contact information; your consent to the jurisdiction of the US federal district court for the district where you are located (or, if your address is outside the United States, the US District Court for the Middle District of Pennsylvania); and a statement that you will accept service of process from the party who filed the copyright notice, or that party's agent. We may restore the material in 10 to 14 business days unless the original complainant files a court action seeking to keep it down. Filing a claim with the Copyright Claims Board (CCB) is a separate, voluntary alternative to court; on its own it does not stop restoration under the DMCA, so a complainant who wants the material kept down during a dispute must pursue a court action.
9. Repeat infringers
Consistent with 17 U.S.C. § 512(i), we maintain and reasonably implement a policy to terminate the accounts of buyers or sellers who repeatedly infringe others' intellectual property, in appropriate circumstances. This includes accounts we reasonably believe are associated with, controlled by, or created to evade a prior termination of a repeat infringer — for example a new shop or account opened to continue conduct we have already acted on. Attempting to circumvent a termination in this way is itself grounds for removal.
10. Trademarks, counterfeits, and other IP
Trademark complaints, counterfeit goods, and other non-copyright IP issues are handled under the Prohibited & Restricted Content Policy — report them the same way, to the contact above.
11. Reporting other content (non-copyright takedown SLA)
To report a listing, design, message, or review that you believe is infringing, counterfeit, deceptive, or otherwise violates our policies but is not a copyright matter, use the reporting link on the item or contact us at hello@craterinkstudios.com. Tell us what the content is, where it appears, and why it violates the rules. We review reports and aim to respond within 5 business days. Copyright complaints must use the DMCA process in Sections 7 and 8 instead.
12. Changes to this policy
We may update this policy; the current version is the one posted here, identified by the effective date above.
